Warranty and conditions for sale

The Code on Consumer Rights (lgs. Decree 206/05), art. 128-135, rules the legal warranty on consumption goods sold to consumers not in physical shops. Such legal warranty covers all production defects and non-compliances found on consumption goods purchased by consumers for a duration of two years. These legal norms envisage the right to rescission, that is the possibility for the consumer to return the purchased product and to be reimbursed for the relative expense incurred.

- RESCISSION OF GOODS

The customer can rescind without penalties and justification, within ten working days from the date of purchase, by sending an email to explain its willingness to rescind addressed to the following: info@healthdivision.it.

Please remember to keep the receipt and Consignment Note of the package delivered by Healthdivision Italia srl, because such documentation will be requested upon returning the purchased goods.

- RESCISSION PROCEDURE

Please send your rescission request via e-mail in advance. You can choose one of the following options:

- Total reimbursement of the purchased goods;

- Credit Note to use for future orders.

If you ask for reimbursement (the equivalent of the total value of the goods adequately returned), the latter will be processed according to the preferred payment modalities to choose among: bank transfer, PostePay, PayPal.

The only expenses incurred by the client are shipping fees. The right to rescission ceases at once in the case in which the product returned differs from the original, that is in case of:

- Absence of elements integrated to the product (accessories, batteries, cables, cases, instruction manuals, etc);

- Damages to the product caused by factors different from trasportation.

The right to collect on delivery or to request extra fees for appointment freight does not result in reimbursment.

- HOW TO PREPARE THE PACKAGING FOR RETURN

You can return the purchased goods in a standard package together with a copy of the receipt and Consignment Note to the following address: Via Vicchio 18, Rome 00148 Italy.

- PARTIAL RESCISSION

In the case in which the rescission involves only part of the goods ordered, you can follow the procedurementioned above for returning the purchased goods. The right to rescission does not apply for the sale of:

- Customised goods;

- Audiovisual products or sealed softwares, whose packaging has been undone by the client (for instance, an sealed DVD);

- Newspapers and magazines;

- Clothing, including unused underwear;

- Items and accessories whose use implies contact with secretions and mucosas (for instance ball gags, dildos, vibrators, etc) yet unused;

- Items on sale or close to exhaustion.

- SUBSTITUTION OF GOODS


The price for the return are charged to the customer who will subsequently make another payment for the resubmission of the product, according to the rates of its Country / Zone.


You have the rigth to substitute the purchased goods, fully or partially. You can replace your product and ask for a different size or even request a completely different item. The reasons for replacing your order can be various and, as such, requests will be managed differently with delivery fees to be charged to the client. Replacement is provided for in the following cases:

- A different size is needed;

- The item in question has been erroneously purchased;

- The purchased item needs to be subsituted with a different good.

In order to obtain susbtitution of the purchased goods, always remember to keep your receipt and the Consignment Note of the package delivered by Healthdivision Italia srl. In addition, please anticipate your request to us by e-mail as explained previously. Finally, please forward your goods to be returned in a standard package together with a copy of your receipt and the Consignment Note to the following address: Via Vicchio 18, Rome 00148 - Italy. If the purchased goods are flawed, please attach a detailed description of the defects in question. You can choose either to receive the same type of item or to request one of the following form of compensation:

-Total reimbursement of the purchased goods;

-Credit Note to use for future orders.

If you ask for reimbursement (the equivalent of the total value of the goods adequately returned), the latter will be processed according to the preferred payment modalities to choose among: bank transfer, PostePay, PayPal.

The only expenses incurred by the client are shipping fees. The items to be substituted will be delivered without any additional charges for delivery only if:

- The item delivered does not match with the order;

- The item delivered is flawed.

The right of compliance is not applicable for the sale of:

- Customised goods;

- Audiovisual products or sealed softwares, whose packaging has been undone by the client (for instance, an sealed DVD);

- Newspapers and magazines;

- Clothing, including unused underwear;

- Items and accessories whose use implies contact with secretions and mucosas (for instance ball gags, dildos, vibrators, etc) yet unused;

- Items on sale or close to exhaustion.

- COMPETENT FORUM

The Roman Forum of lawyers is exclusively competent for any controversies which might arise in relation to the purchase of goods distributed by Healthdivision Italia srl.

- GENERAL CONDITIONS

The conditions contained in the present document can be modified according to the law without previous notice and will be valid starting from the date in which they will be published in the official website: www.healthdivision.it
